Under the patronage of Professor Dr. Anees Khalil Nail, Dean of the College of Medicine at Al-Nahrain University, the Legal Division, in cooperation with the Continuing Education Unit, held a workshop entitled:
“Medical Expertise in Criminal Cases.”
The workshop was presented by Assistant Lecturer Mouj Kareem Ghadab, with the participation of a number of staff members and faculty of the college. The session discussed the importance of medical expertise as a fundamental means of evidence relied upon by the criminal judge in cases of a scientific and medical nature that require specialized technical opinions contributing to the formation of judicial conviction and the establishment or dismissal of charges.
The lecturer emphasized that the criminal judge cannot decide on medical cases without consulting experts, as such cases involve scientific details that require analysis and evaluation by specialists in the medical field.
The workshop concluded with several recommendations, most notably emphasizing the importance of the role of the medical expert in criminal proceedings, the need to allow experts from outside the official registers to participate, and not to restrict medical expertise only to registered employees. It also recommended granting medical experts the authority to seek assistance from others when necessary with the approval of the competent court, as well as calling for the updating and unification of relevant legislation within a comprehensive law.
