Student Discipline Instructions in Higher Education Institutions

Basis: Based on the provisions of Paragraph (2) of Article (37) and Paragraph (2) of Article (47) of the Ministry of Higher Education and Scientific Research Law No. (40) of 1988.
Article 1: Student Obligations
The student adheres to the following:
- First: Adherence to the laws, regulations, internal bylaws, and instructions issued by the Ministry of Higher Education and Scientific Research and its institutions.
- Second: Not infringing upon religious beliefs, national unity, or national feelings by maliciously or intentionally inciting sectarian, ethnic, or religious strife, whether by word or deed.
- Third: Not harming the reputation of the Ministry or its institutions by word or deed, inside or outside them.
- Fourth: Avoiding everything that contradicts university behavior of high discipline and respect for the administration, faculty, staff, and relationships of fellowship and cooperation among students.
- Fifth: Disciplined and upright behavior that will positively affect them upon appointment and nomination for scholarships and fellowships.
- Sixth: Refraining from any act that would disrupt order, peace, and tranquility inside the university campus (college or institute) or participating in it, inciting it, or covering up for those carrying it out.
- Seventh: Preserving study materials and the property of the University, Commission, College, or Institute.
- Eighth: Not disrupting the proper conduct of study in the College or Institute.
- Ninth: Adherence to the uniform prescribed for students, taking into account the privacy of each university or commission separately.
- Tenth: Avoiding calling for the establishment of organizations that would deepen division or practicing any form of political, religious, or social persecution.
- Eleventh: Avoiding propaganda for any party, political organization, or ethnic, national, or sectarian group, whether by hanging pictures, banners, and posters, or holding seminars.
- Twelfth: Not inviting partisan figures to give lectures or hold partisan or religious propaganda seminars inside the university campus to preserve national unity.
Article 2: The Penalty of Alert
The student is punished with an Alert if they commit one of the following violations:
- First: Non-adherence to the uniform prescribed in the University or Commission.
- Second: Offending the relationships of fellowship between students or verbally abusing a student.
Article 3: The Penalty of Alert (Aggravated)
The student is punished with an Alert if they commit one of the following violations:
- First: An act requiring punishment by Alert, having previously been punished with an Alert penalty.
- Second: Disrupting order, peace, and tranquility in the University, Commission, College, or Institute.
Article 4: Dismissal for (30) Days
The student is punished with Dismissal for (30) thirty days if they commit one of the following violations:
- First: An act requiring punishment by Warning, having previously been punished with a Warning penalty.
- Second: Verbally abusing one of the university affiliates who are not members of the faculty.
- Third: Defaming a faculty member in a way that harms them inside the College or Institute or outside them.
- Fourth: Placing posters – inside the university campus – that violate public order and morals.
Article 5: Temporary Dismissal (One Academic Year)
The student is punished with Temporary Dismissal from the University for a period not exceeding one academic year if they commit one of the following violations:
- First: If they repeat committing one of the acts stipulated in Article (4) of these instructions.
- Second: Practicing or inciting sectarian or ethnic blocs or political or partisan gatherings inside the university campus.
- Third: Physically assaulting one of the university affiliates who are not members of the faculty.
- Fourth: Using violence against their student colleagues.
- Fifth: Threatening to carry out acts of armed violence.
- Sixth: Carrying weapons of all kinds with or without a license inside the university campus.
- Seventh: Causing intentionally or by gross negligence damage to the property of the University, Commission, College, or Institute.
- Eighth: Offending national unity or religious beliefs.
- Ninth: Verbally abusing one of the faculty members inside the College or Institute or outside them.
- Tenth: Offending the reputation of the University or Commission by word or deed.
- Eleventh: Intentional disruption of the proper conduct of study.
- Twelfth: Proven commission of fraud and swindling against their student colleagues and affiliates of the College or Institute.
Article 6: Final Dismissal (Registration Termination)
The student is punished with Final Dismissal from the College or Institute and by a decision from the University or Commission, and their registration is terminated, if they commit one of the following violations:
- First: Repeating one of the violations stipulated in Article (5) of these instructions.
- Second: Physically assaulting one of the faculty members or lecturers in the University, Commission, College, or Institute.
- Third: Committing a disgraceful act contrary to public morals and ethics.
- Fourth: Submitting any forged documents, books, or papers knowing they are forged, or being one of the instigators of forgery.
- Fifth: Proven commission of an act that breaches security and tranquility inside the university campus or participating in it or assisting in it.
- Sixth: Upon being sentenced for a felony or misdemeanor involving moral turpitude for a period of more than one year.
General Provisions (Articles 7 - 15)
- Article 7: The imposition of disciplinary penalties does not prevent the imposition of other penalties if the violation falls under penal laws.
- Article 8: A Student Discipline Committee is formed, headed by the Assistant Dean, with the membership of two faculty members (one legal) and a student representative.
- Article 9: No penalty may be imposed unless recommended by the Student Discipline Committee.
- Article 10: Penalties are imposed by a decision of the College/Institute Council, or the Dean (upon authorization).
- Article 11: The penalties of Alert and Warning are final. The penalty of Dismissal (30 days) is appealable to the College Council.
- Article 12: The student has the right to object to Dismissal decisions (Temporary or Final) within 7 days of notification or 15 days of publication.
- Article 13: The penalty decision hangs on the bulletin board for 15 days, and the student's guardian is notified in writing.
