Based on the provisions of Paragraph (2) of Article (37) and Paragraph (2) of Article (47) of the Ministry of Higher Education and Scientific Research Law No. (40) of 1988.

 

Article 1

 

The student is committed to the following:

First - Adherence to the laws, regulations, internal regulations, instructions and orders issued by the Ministry of Higher Education and Scientific Research and its institutions (university, authority, college, institute).

Second - Not to harm religious beliefs, national unity or national feelings by harm or intentionally incite sectarian, ethnic or religious strife by action or word.

Third - Not to harm the reputation of the Ministry or its institutions by word or deed inside or outside it.

Fourth - Avoid everything that is inconsistent with university behavior of high discipline and respect for the administration, faculty and employees and relationships of fellowship and cooperation between students.

Fifth - Disciplined and upright behavior that will positively affect it when appointed and nominated for scholarships and study fellowships.

Sixth - Refrain from any act that would disrupt the order, tranquility and peace within the university campus (college or institute) or participate in it, incite it or cover up for those who do it.

Seventh - Preserve the educational requirements and property of the university, body, college or institute.

Eighth - Not to disrupt the smooth running of studies in the college or institute.

Ninth - Adherence to the uniform prescribed for students, taking into account the privacy of each university or institution separately.

Tenth - Avoid calling for the establishment of organizations that would deepen division or practice any type of political, religious or social persecution.

Eleventh - Avoid propaganda for any party or political organization or ethnic, national or sectarian group, whether by hanging pictures, banners and posters or holding seminars.

Twelfth - Not inviting party figures to give lectures or hold party or religious propaganda seminars on campus in order to preserve national unity.

Article 2

 

A student shall be punished by warning if he commits one of the following violations:

First - Failure to adhere to the uniform prescribed by the university or institution.

Second - Insulting the relationships of colleagues among students or exceeding them by speaking to any student.

Article 3

 

A student shall be punished with a warning if he commits one of the following violations:

First - An act that requires punishment with a warning, if he has previously been punished with a warning.

Second - Disrupting the order, peace and tranquility in the university, body, college or institute.

Article 4

 

A student shall be punished with expulsion for a period of (30) thirty days if he commits one of the following violations:

First - An act that requires punishment with a warning, if he has previously been punished with a warning.

Second - His verbal abuse of a university member other than a faculty member.

Third - His defamation of a faculty member in a way that offends him inside or outside the college or institute.

Fourth - His placing posters - inside the university campus - that violate public order and morals.

Article 5

 

A student shall be punished by temporary dismissal from the university for a period not exceeding one academic year if he commits one of the following violations:

First - If he repeatedly commits one of the acts stipulated in Article (4) of these instructions.

Second - Practices or incites sectarian or ethnic blocs or political or partisan gatherings within the university campus.

Third - Actual assault on any of the university members other than faculty members.

Fourth - Uses violence against his fellow students.

Fifth - Threatens to commit armed violence.

Sixth - Carries weapons of any kind with or without permission within the university campus.

Seventh - Intentionally or through gross negligence causes damage to the property of the university, authority, college or institute.

Eighth - Offends national unity or religious beliefs.

Ninth - Verbally abuses any of the faculty members inside or outside the college or institute.

Tenth - Insulting the reputation of the university or the authority by word or deed.

Eleventh - His deliberate disruption of the proper conduct of studies.

Twelfth - Proof of committing fraud and deception against his fellow students and members of the college or institute.

Article 6

 

The student shall be punished by final expulsion from the college or institute by a decision of the university or the authority and his registration shall be suspended if he commits one of the following violations:

First - Repeating one of the violations stipulated in Article (5) of these instructions.

Second - Actual assault on a member of the teaching staff or lecturers at the university, authority, college or institute.

Third - Committing a shameful act that is contrary to public morals and ethics.

Fourth - Submitting any forged documents, books or papers knowing that they are forged or being one of the instigators of forgery.

Fifth - Proof of committing an act that disturbs security and tranquility within the university campus or participating in or assisting in it.

Sixth - When he is sentenced for a felony or misdemeanor that violates honor and the period of his sentence exceeds one year.

Article 7

 

First - The imposition of the penalties stipulated in Articles (2), (3), (4), (5) and (6) of these instructions on the violating student does not prevent the imposition of other penalties if the violation falls under the scope of the penal laws.

Second - If a criminal case is filed against the student for an act attributed to him outside the university or institute, the consideration of it shall be a disciplinary postponement until the criminal case is decided.

Article 8

 

The Dean of the College or Institute shall form a Student Disciplinary Committee headed by the Assistant Dean and the membership of two members of the teaching staff, provided that one of the members of the committee is a legal expert. A representative of the Student Union (elected) and one of the administrative employees shall be assigned to the duties of the committee’s rapporteur.

 

Article 9

 

No disciplinary penalty may be imposed unless recommended by the Student Discipline Committee.

 

Article 10

 

The disciplinary penalties stipulated in these instructions shall be imposed by a decision of the College or Institute Council, and the Council may delegate its powers to the Dean of the College or Institute.

 

Article 11

 

First - The penalty of warning and reprimand shall be final.

Second - A student dismissed from the College or Institute for a period not exceeding (30) thirty days may object to the dismissal decision before the College or Institute Council, and its decision shall be final.

Article 12

 

The student has the right to object to the dismissal decisions stipulated in clauses (second), (third) and (fourth) of Article (11) of these instructions within (7) seven days from the date of notification of the decision issued against him. If he cannot be notified, he has the right to object within (15) fifteen days from the date of publishing the dismissal decision on the bulletin board.

 

Article 13

 

The penalty decision shall be posted on the bulletin board in the college or institute for a period of not less than (15) fifteen days, and the student's guardian shall be notified thereof in writing.

 

Article 14

 

Higher Education Students Discipline Instructions No. (19) of 1989 shall be cancelled.

 

Article 15

 

These instructions shall be implemented from the date of their publication in the Official Gazette.
